1. Information We Collect

  1. Information Provided to Us. We collect information you provide to us, for example when you create or modify your account, register to use the Site, purchase products or services, request information from us, contact customer support, or otherwise communicate with us. This information may include your name, address, date of birth, social security or tax identification number, billing address, email, telephone, gender, credit card information, bank information, login credentials, Google and/or Facebook account information, and other content you may provide, including certain “Personal Information,” which means any information relating to an identified or identifiable individual.
  2. Information Collected from Customers. Additional information we collect from electronic vehicle (“EV”) owners and our customers includes: profile image, EV-specific information, and booking/services information such as availability, service preferences, and current location.
  3. Information Collected from EV Charging Station Owners (“Hosts”). Additional information we collect from Hosts includes: profile image, EV charger location, performance and use information, and business name, logo, and other business-specific information.
  4. Site Usage Information. We may receive and store certain types of information whenever you visit the Site, such as click-stream data and your IP address.
  5. Email Communications. When you open emails from us, we may receive a confirmation noting you opened an email. We may keep track of the emails we send you. Additionally, we keep a record of what types of emails you have opted to receive and not to receive.
  6. Information from Other Sources. We may receive information about you from other sources.
  7. California Residents. We may collect Personal Information as defined by the California Consumer Privacy Act, which is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information does not include de-identified or aggregate information, publicly available information that is lawfully made available from federal, state, or local government records, and information covered by certain sector-specific privacy laws. In the 12 months preceding the date this Privacy Policy was last updated, Emobi has collected Personal Information from users including payment information, personal contact information, business information, log-in credentials, usage details, and technical details. This information has not been disclosed or sold.
  8. Children. Our Site is not intended for children under 13 years of age, and we do not knowingly collect Personal Information from children under 13. If you are under 13 years old, do not use or provide any information on our Site without a parent or legal guardian present. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete it. 2. How Information Is Collected

  1. Registration. You may be asked to complete a registration form and provide Personal Information. You may also be asked to choose a username and password in order to take advantage of certain features the Site.
  2. Newsletters and Emails. We may offer free newsletters or send emails about announcements and special offers from advertisers and sponsors. You may receive a newsletter either by registering for it or in conjunction with a special feature or forum membership. You may cancel your free newsletter or email subscription by following the instructions provided in the designated area of the newsletter or email, or by Contacting Us.
  3. Cookies. The Site uses "cookies," which are small data files that automatically identify your Web browser to the Site whenever you visit the Site. Cookies save your preferences, which makes using the Site easier. Cookies are also a valuable source of information for helping us improve and update the Site.
  4. IP Addresses and Click-stream Data. We may collect your IP address and click-stream data, which we use for system administration and report the aggregate information to our advertisers and sponsors. An IP address is a number that is automatically assigned to your computer whenever you access the Internet. Click-stream data may include such information as the page served, the time, the source of the request, the type of browser making the request, the preceding page viewed.

Transaction Information. If you purchase a product or services from our Site, we will request certain information in order to complete the transaction, such as bank information, credit-card number, expiration date, and billing and shipping addresses. Such information is collected and stored through encrypted means for your protection. Credit-card numbers and CVV codes are not stored on our computers.
  6. When you visit or log in to our website, cookies  and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. 3. How We Use and Share Your Information

  1. To Enhance Your Experience. We use user-data to analyze our members' usage patterns, interests and general behavior, and to better understand and serve you and our community. In addition, we use the information we collect from you to provide and improve products and services available on the Site, provide information that you request from us, and to keep you informed of updates to our Site and promote new offerings. We use your Personal Information to contact you about your orders or inquiries, process credit card and debit card transactions, ship products to you, and enhance your customer experience.
  2. Sharing with Third Parties. We may provide information to third party service providers that help us operate and manage our Site, facilitate transactions, process orders, and fulfill and deliver products and services that you purchase from us. These service providers will have access to your Personal Information in order to provide these services, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

Interest-based ads are ads presented to you based on your browsing behavior. Interest-based ads may be presented to you while you are browsing our Site or third-party sites not owned by Emobi. We contract with third party service providers to help manage and optimize our business and communications. Our analytics partners help us measure the effectiveness of our advertising and monitor user preferences.
  4. Do Not Track. Currently, our Site does not recognize “do not track” signals or similar mechanisms indicating you do not wish to be tracked or receive interest-based ads. Please note that if you choose to opt out, you will continue to see ads on our Site, but they will not be based on how you browse and shop.
  5. Your Consent. We may share your Personal Information with companies, organizations or individuals outside of Emobi when we have your consent to do so.
  6. Legal Proceedings. We may share your Personal Information with third party companies, organizations or individuals outside of Emobi if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:
    1. Meet any applicable law, regulation, subpoena, legal process or enforceable governmental request;
    2. Enforce applicable Terms of Use, including investigation of potential violations;
    3. Detect, prevent, or otherwise address fraud, security or technical issues;
    4. Protect against harm to the rights, property or safety of Emobi, our users, customers or the public as required or permitted by law.
  7. Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your Personal Information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy.

4. Access To Your Information

  1. Access; Closure. You can access and update certain information we have relating to your online account by signing into your account through the Site. If you have questions about Personal Information we have about you, need to update your information, or wish to opt-out of receiving certain emails or communication from us, you can Contact Us. You can close your account by Contacting Us. If you close your account, we will no longer use your online account information or share it with third parties. We may, however, retain a copy of the information for archival purposes, and to avoid identity theft or fraud.

    • Requests to Delete. California residents have the right to request that we delete Personal Information about you that we collected and maintain, subject to certain exceptions. To make such a request, please Contact Us. In order to verify your request, Emobi may require you to provide additional information to confirm your identity. Once we verify your request, we will delete and direct our service providers to delete your Personal Information, unless an exception applies.
    • Opt-Out of the Sale of Personal Information. California residents have the right to opt-out of the sale of your Personal Information. To make such a request, please Contact Us by email. To opt-out of Emobi sharing your Personal Information with third parties to advertise our Site, please additionally manage opt-out privacy controls.
    • “Shine the Light” Request. California residents may also have the right to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please Contact Us.

5. Security of Your Information

However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our Site are not encrypted, and we strongly advise you not to communicate any confidential information through these means. Emobi will notify you by email or other means as permitted or required by law if it is determined that a data security incident has occurred.
  2. Retention. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When determining the appropriate retention period for Personal Information, we take into account various criteria, such as the amount, nature and sensitivity of the Personal Information; potential risk of harm from unauthorized use or disclosure; purposes for which we process your Personal Information; whether we can achieve those purposes through other means; and business operations and legal requirements. Because we maintain our Site to protect from accidental or malicious loss and destruction, residual copies of your Personal Information may be retained in our backup and archival systems for a limited period of time, after which the information will be automatically deleted or put beyond use where deletion is not possible.

6. Users Outside the United States

  1. Consent to US Processing.   2. GDPR Disclaimer. The Site is not intended to be used by individuals residing in the European Union, is not advertised or directed towards individuals residing in the European Union. However, we make good faith efforts to comply with GDPR, and to that end we expressly provide that European Union residents have a right to consent to how Emobi uses your data. Above, we have described the data points we collect and how this information may be used. We never abuse your information. Under GDPR you have the right to ask for all the data collected on you by written request. Your data is stored in a secure database. It will take up to 72 hours to retrieve and send you collected data. The data will be provided in the form on a spreadsheet and sent via personal email. Your right to be forgotten refers to your right to have your information wiped from our database. If you wish for your information to be removed please Contact Us and we will confirm your information is removed via email within 72 hours.

7. Changes to our Privacy Policy

  1. Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law.
